Jak\u00e1 je?<\/a><\/p>\n<p>Novela p\u016fsob\u00ed v\u011bcn\u011b, rozumn\u011b, koncep\u010dn\u011b.\u00a0N\u00ed\u017ee cituji \u00faryvky z dokumentu, kter\u00e9 mne zaujaly:<br \/> <em><\/em><\/p>\n<p><em>&#8220;V\u00a0sou\u010dasn\u00e9 dob\u011b doch\u00e1z\u00ed k progresivn\u00edmu n\u00e1r\u016fstu poskytovan\u00e9ho doplatku na bydlen\u00ed, a to nejenom z\u00a0d\u016fvodu dopad\u016f ekonomick\u00e9 krize, ale i proto, \u017ee se \u0159ada ob\u010dan\u016f nau\u010dila ur\u010dit\u00e9 v\u00fdhody z\u00e1kona o pomoci v\u00a0hmotn\u00e9 nouzi vyu\u017e\u00edvat. Proto se navrhuj\u00ed ur\u010dit\u00e1 zp\u0159\u00edsn\u011bn\u00ed p\u0159i posuzov\u00e1n\u00ed situace hmotn\u00e9 nouze osoby pro \u00fa\u010dely doplatku na bydlen\u00ed na stran\u011b jedn\u00e9 a zjednodu\u0161en\u00ed \u0159\u00edzen\u00ed o doplatku na bydlen\u00ed na stran\u011b druh\u00e9.&#8221;<\/em><\/p>\n<p><em>&#8220;Navrhovan\u00e9 legislativn\u00ed \u0159e\u0161en\u00ed p\u0159edev\u0161\u00edm upravuje:\u00a0<\/em><em>\u00a0zm\u011bnu stanoven\u00ed okruhu spole\u010dn\u011b posuzovan\u00fdch osob pro \u00fa\u010dely doplatku na bydlen\u00ed,<\/em><\/p>\n<ul>\n<li><em>stanoven\u00ed v\u00fd\u0161e od\u016fvodn\u011bn\u00fdch n\u00e1klad\u016f na bydlen\u00ed tak, aby byl v\u00a0r\u00e1mci jednoho bytu \u010di jin\u00e9ho ne\u017e obytn\u00e9ho prostoru poskytnut pouze jeden doplatek na bydlen\u00ed,<\/em><\/li>\n<li><em>zapo\u010d\u00edt\u00e1v\u00e1n\u00ed d\u00e1vek z\u00a0d\u016fchodov\u00e9ho poji\u0161t\u011bn\u00ed pro \u00fa\u010dely d\u00e1vek pomoci v\u00a0hmotn\u00e9 nouzi v\u00a0ne\u00fapln\u00e9 v\u00fd\u0161i,<\/em><\/li>\n<li><em>zp\u0159esn\u011bn\u00ed rozhodn\u00e9ho obdob\u00ed v\u00a0m\u011bs\u00edci pod\u00e1n\u00ed \u017e\u00e1dosti o opakuj\u00edc\u00ed se d\u00e1vku a v\u00a0obdob\u00ed jej\u00edho poskytov\u00e1n\u00ed,<\/em><\/li>\n<li><em>hodnocen\u00ed vyu\u017eit\u00ed zv\u00fd\u0161en\u00ed p\u0159\u00edjmu vlastn\u00edm p\u0159i\u010din\u011bn\u00edm pro doplatek na bydlen\u00ed a\u00a0odejmut\u00ed opakuj\u00edc\u00ed se d\u00e1vky p\u0159i neuplatn\u011bn\u00ed majetku, pohled\u00e1vek \u010di n\u00e1rok\u016f a mo\u017enost nov\u00e9ho n\u00e1roku na tuto d\u00e1vku,<\/em><\/li>\n<li><em>zp\u0159esn\u011bn\u00ed podm\u00ednek n\u00e1roku na doplatek na bydlen\u00ed,<\/em><\/li>\n<li><em>dopln\u011bn\u00ed definice bytu a jin\u00e9ho ne\u017e obytn\u00e9ho prostoru,<\/em><\/li>\n<li><em>standardy kvality bydlen\u00ed jin\u00e9ho ne\u017e obytn\u00e9ho prostoru a jejich kontrolu,<\/em><\/li>\n<li><em>zru\u0161en\u00ed \u010dasov\u00e9ho omezen\u00ed poskytov\u00e1n\u00ed doplatku na bydlen\u00ed,<\/em><\/li>\n<li><em>jak\u00e9 doklady mus\u00ed b\u00fdt k\u00a0\u017e\u00e1dosti o opakuj\u00edc\u00ed se d\u00e1vky pomoci v hmotn\u00e9 nouzi p\u0159ilo\u017eeny. &#8220;<\/em><\/li>\n<\/ul>\n<p><em>&#8220;Okruh spole\u010dn\u011b posuzovan\u00fdch osob se ur\u010duje podle p\u0159\u00edsp\u011bvku na bydlen\u00ed ze syst\u00e9mu st\u00e1tn\u00ed soci\u00e1ln\u00ed podpory s\u00a0v\u00fdjimkou situace, kdy osoby u\u017e\u00edvaj\u00ed jinou ne\u017e n\u00e1jemn\u00ed formu bydlen\u00ed. Okruh spole\u010dn\u011b posuzovan\u00fdch osob se pak m\u016f\u017ee li\u0161it od okruhu stanoven\u00e9ho pro p\u0159\u00edsp\u011bvek na \u017eivobyt\u00ed. Okruh spole\u010dn\u011b posuzovan\u00fdch osob je tedy obt\u00ed\u017en\u011b stanoviteln\u00fd a jeho stanoven\u00ed pro ka\u017edou opakuj\u00edc\u00ed se d\u00e1vku zvl\u00e1\u0161\u0165 p\u0159\u00edli\u0161 administrativn\u011b zat\u011b\u017euje org\u00e1n pomoci v\u00a0hmotn\u00e9 nouzi. Tak\u00e9 m\u016f\u017ee doch\u00e1zet k\u00a0situac\u00edm, \u017ee se vypl\u00e1c\u00ed v\u00edce doplatk\u016f na bydlen\u00ed do jednoho bytu a v\u00a0posledn\u00ed dob\u011b t\u00e9to skute\u010dnosti za\u010dali vyu\u017e\u00edvat hlavn\u011b majitel\u00e9 ubytovac\u00edch za\u0159\u00edzen\u00ed \u00a0<\/em><em>a doplatkem na bydlen\u00ed se tak hrad\u00ed n\u00e1klady spojen\u00e9 s\u00a0bydlen\u00edm, kter\u00e9 v\u00a0sou\u010dtu mnohon\u00e1sobn\u011b p\u0159evy\u0161uj\u00ed n\u00e1jemn\u00e9 v\u00a0m\u00edst\u011b obvykl\u00e9 (v\u010detn\u011b energi\u00ed a slu\u017eeb) ur\u010den\u00e9 pro jeden byt \u010di m\u00edstnost v\u00a0ubytovac\u00edm za\u0159\u00edzen\u00ed. &#8220;<\/em><\/p>\n<p><em>&#8220;V\u00fdvoj pr\u016fm\u011brn\u00e9ho po\u010dtu p\u0159\u00edjemc\u016f s\u00a0n\u00e1rokem na doplatek na bydlen\u00ed v\u00a0roce 2011 byl 24,4 tis. p\u0159\u00edjemc\u016f a v\u00a0roce 2012 narostl na 41,5 tis. p\u0159\u00edjemc\u016f \u00a0<\/em><em>a v\u00a0roce 2013 na 65,1 tis. p\u0159\u00edjemc\u016f. Obdobn\u011b vzrostly i celkov\u00e9 n\u00e1klady na tuto d\u00e1vku &#8211; v\u00a0roce 2011 \u010dinily 850 mil. K\u010d a v\u00a0roce 2012 se zv\u00fd\u0161ily na 1\u00a0673 mil. K\u010d a v\u00a0roce 2013 na 2\u00a0814 mil K\u010d. &#8220;<\/em><\/p>\n<p>&nbsp;<\/p>\n<p><strong>C\u00edl<\/strong><\/p>\n<p><em>&#8220;C\u00edlov\u00fdm stavem pr\u00e1vn\u00ed \u00fapravy je poskytovat doplatek na bydlen\u00ed v\u00a0p\u0159im\u011b\u0159en\u00e9 v\u00fd\u0161i pouze \u00a0do vyhovuj\u00edc\u00edho bydlen\u00ed (d\u016fstojn\u00e9ho bydlen\u00ed) a zjednodu\u0161it administraci t\u00e9to d\u00e1vky. C\u00edlov\u00fd stav v\u00a0jednotliv\u00fdch oblastech navrhovan\u00e9 pr\u00e1vn\u00ed \u00fapravy je n\u00e1sleduj\u00edc\u00ed:\u00a0<\/em><\/p>\n<ul>\n<li><em>C\u00edlem je zm\u011bnit stanoven\u00ed okruhu spole\u010dn\u011b posuzovan\u00fdch osob pro \u00fa\u010dely doplatku <\/em><em>na bydlen\u00ed tak, aby se okruh ur\u010doval stejn\u011b jako u p\u0159\u00edsp\u011bvku na \u017eivobyt\u00ed a v\u00a0kone\u010dn\u00e9m d\u016fsledku byly spole\u010dn\u011b posuzov\u00e1ny osoby, kter\u00e9 spolu fakticky u\u017e\u00edvaj\u00ed byt a maj\u00ed k\u00a0sob\u011b stanovenou vy\u017eivovac\u00ed povinnost nebo spole\u010dn\u011b hospoda\u0159\u00ed.\u00a0<\/em><\/li>\n<\/ul>\n<ul>\n<li><em>V\u00a0souvislosti s\u00a0neomezenou mo\u017enost\u00ed poskytovat v\u00edce doplatk\u016f na bydlen\u00ed do jednoho bytu \u010di m\u00edstnosti v\u00a0nestandardn\u00ed form\u011b bydlen\u00ed a snaze o dosa\u017een\u00ed \u00faspor v\u00a0t\u00e9to oblasti <\/em><em>se navrhuje ur\u010dit v\u00fd\u0161i od\u016fvodn\u011bn\u00fdch n\u00e1klad\u016f na bydlen\u00ed tak, aby sou\u010det t\u011bchto doplatk\u016f na bydlen\u00ed tvo\u0159il celkovou sumu jednoho doplatku na bydlen\u00ed odpov\u00eddaj\u00edc\u00ed po\u010dtu osob fakticky u\u017e\u00edvaj\u00edc\u00ed byt nebo jin\u00fd ne\u017e obytn\u00fd prostor. \u00a0<\/em><\/li>\n<\/ul>\n<ul>\n<li><em>Dosavadn\u00ed pr\u00e1vn\u00ed \u00faprava v\u016fbec nezv\u00fdhod\u0148uje osoby, kter\u00e9 pracovaly a hradily \u00a0si d\u016fchodov\u00e9 poji\u0161t\u011bn\u00ed a nyn\u00ed maj\u00ed n\u00e1rok na d\u00e1vky z\u00a0tohoto poji\u0161t\u011bn\u00ed. T\u011bmto lidem <\/em><br \/> <em> se navrhuje zapo\u010d\u00edt\u00e1vat jejich d\u00e1vky z\u00a0d\u016fchodov\u00e9ho poji\u0161t\u011bn\u00ed pouze z\u010d\u00e1sti, jako je tomu u zapo\u010d\u00edt\u00e1v\u00e1n\u00ed d\u00e1vek z\u00a0nemocensk\u00e9ho poji\u0161t\u011bn\u00ed.\u00a0<\/em><\/li>\n<\/ul>\n<ul>\n<li><em>S\u00a0\u00famyslem sn\u00ed\u017eit administrativn\u00ed z\u00e1t\u011b\u017e zam\u011bstnanc\u016f org\u00e1nu pomoci v\u00a0hmotn\u00e9 nouzi se navrhuje zp\u0159esn\u011bn\u00ed rozhodn\u00e9ho obdob\u00ed, ve kter\u00e9m se hodnot\u00ed podm\u00ednky n\u00e1roku na d\u00e1vku a jej\u00ed v\u00fd\u0161e. \u00a0<\/em><\/li>\n<\/ul>\n<ul>\n<ul>\n<ul>\n<ul>\n<li><em>S\u00a0c\u00edlem prohloubit motivaci osob aktivn\u011b si zv\u00fd\u0161it p\u0159\u00edjem vlastn\u00edm p\u0159i\u010din\u011bn\u00edm se navrhuje, aby osoby, kter\u00e9 maj\u00ed mo\u017enost z\u00edskat z\u00a0vlastn\u00edch zdroj\u016f finan\u010dn\u00ed prost\u0159edky, tyto prost\u0159edky pou\u017eily pro uhrazen\u00ed n\u00e1klad\u016f na sv\u00e9 pot\u0159eby. Nab\u00edz\u00ed se proto zav\u00e9st hodnocen\u00ed vyu\u017eit\u00ed zv\u00fd\u0161en\u00ed p\u0159\u00edjmu vlastn\u00edm p\u0159i\u010din\u011bn\u00edm i u doplatku na bydlen\u00ed a ne pouze u p\u0159\u00edsp\u011bvku na \u017eivobyt\u00ed, jak je tomu za sou\u010dasn\u00e9ho pr\u00e1vn\u00edho stavu. P\u0159i neuplatn\u011bn\u00ed zv\u00fd\u0161en\u00ed p\u0159\u00edjmu vlastn\u00edm p\u0159i\u010din\u011bn\u00edm by pak osoba nebyla v\u00a0hmotn\u00e9 nouzi a nem\u011bla by n\u00e1rok na d\u00e1vky pomoci v\u00a0hmotn\u00e9 nouzi a dal\u0161\u00ed n\u00e1rok by mohl osob\u011b vzniknout a\u017e po uplynut\u00ed ur\u010dit\u00e9 doby.<\/em><\/li>\n<li><em>Aby skupiny obyvatel, kter\u00e9 jsou ohro\u017eeny soci\u00e1ln\u00edm vylou\u010den\u00edm, nebyly vytla\u010dov\u00e1ny do substandardn\u00ed formy bydlen\u00ed, navrhuje se specifikovat, jak\u00e9 standardy kvality bydlen\u00ed m\u00e1 jin\u00fd ne\u017e obytn\u00fd prostor spl\u0148ovat a kdo tyto standardy bude kontrolovat, aby do takov\u00e9ho prostoru mohl b\u00fdt poskytnut doplatek na bydlen\u00ed.
