Navr\u017een\u00e1 novela nem\u00e1 p\u0159edpoklady cokoli zm\u011bnit. Praxe ukazuje, \u017ee na ochranu na\u0161eho kulturn\u00edho d\u011bdictv\u00ed nesta\u010d\u00ed. Z\u00e1kon je nejen zbyte\u010dn\u011b slo\u017eit\u00fd, ale i tak v\u0161eobecn\u00fd, \u017ee v\u00a0mnoha p\u0159\u00edpadech umo\u017e\u0148uje jak\u00fdkoli v\u00fdklad v\u00a0praxi. V\u00fdkon instituc\u00ed pam\u00e1tkov\u00e9 p\u00e9\u010de je dnes poznamen\u00e1n potla\u010den\u00edm odbornosti na \u00fakor \u00fa\u0159edn\u00edch v\u00fdkon\u016f, procesn\u00ed postup podle z\u00e1kona je hlavn\u00edm c\u00edlem, kvalita rozhodnut\u00ed z\u00a0odborn\u00e9ho hlediska je mnohdy velmi problematick\u00e1. Novela z\u00e1kona je op\u011bt zam\u011b\u0159ena p\u0159edev\u0161\u00edm na postup \u00fa\u0159edn\u00edch v\u00fdkon\u016f, kvalita rozhodnut\u00ed ovlivn\u011bna op\u011bt nen\u00ed.<\/p>\n<p>Nedostatkem z\u00e1kona nen\u00ed toti\u017e jen nej\u010dast\u011bji uv\u00e1d\u011bn\u00e1 p\u0159\u00edli\u0161n\u00e1 slo\u017eitost textu i postupu procesn\u00edho \u0159\u00edzen\u00ed. Sebel\u00e9pe domy\u0161len\u00e9 postupy \u00fa\u0159edn\u00edch v\u00fdkon\u016f nezajist\u00ed ochranu pam\u00e1tkov\u00fdch objekt\u016f a hlavn\u011b m\u011bst a z\u00f3n, pokud v n\u011bm nebude zohledn\u011bn ur\u010dit\u00fd n\u00e1zorov\u00fd konsenzus, jak\u00fdm zp\u016fsobem k\u00a0pam\u00e1tkov\u00e9 ochran\u011b p\u0159istupovat, jak\u00e9 by m\u011bly b\u00fdt jej\u00ed priority. P\u0159i sou\u010dasn\u00e9m stavu pam\u00e1tkov\u00e9ho z\u00e1kona jsou rozhodnut\u00ed a stanoviska pam\u00e1tkov\u00e9 p\u00e9\u010de nekoordinovan\u00e1, z\u00e1visl\u00e1 pouze na kvalifikaci jednotliv\u00fdch \u00fazemn\u011b p\u0159\u00edslu\u0161n\u00fdch \u00fa\u0159edn\u00edk\u016f. Praxe p\u0159in\u00e1\u0161\u00ed problematick\u00e9 v\u00fdsledky a otev\u00edr\u00e1 prostor pro korupci. Stovky ob\u010dansk\u00fdch aktivist\u016f zoufale br\u00e1n\u00ed sv\u00e1 m\u011bsta proti mnohdy nep\u0159ijateln\u00fdm rozhodnut\u00edm NP\u00da a stavebn\u00edch \u00fa\u0159ad\u016f.<\/p>\n<p>P\u0159i p\u0159\u00edstupu k\u00a0t\u00e9to problematice mus\u00edme vych\u00e1zet i ze skute\u010dnosti, \u017ee nedostatek n\u00e1zorov\u00e9ho konsenzu nepostihuje jen ochranu pam\u00e1tek \u2013 je v\u00a0sou\u010dasn\u00e9 spole\u010dnosti doslova v\u0161udyp\u0159\u00edtomn\u00fd.<\/p>\n<p>Sou\u010dasn\u00fd pam\u00e1tkov\u00fd z\u00e1kon je zam\u011b\u0159en p\u0159edev\u0161\u00edm k\u00a0ochran\u011b fyzick\u00e9 podstaty registrovan\u00fdch hmotn\u00fdch pam\u00e1tek, prakticky chyb\u00ed \u00fa\u010dinn\u00e1 ochrana kulturn\u00edch hodnot krajiny, plo\u0161n\u00e1 ochrana m\u011bst a nehmotn\u00e9ho kulturn\u00edho d\u011bdictv\u00ed. V\u00a0NP\u00da chyb\u00ed odborn\u00edci zam\u011b\u0159en\u00ed na urbanismus historick\u00fdch m\u011bst.<\/p>\n<p>Relativn\u011b dob\u0159e byla definov\u00e1na ochrana jednotliv\u00fdch registrovan\u00fdch architektonick\u00fdch objekt\u016f. Povinnou sou\u010d\u00e1st\u00ed projektov\u00e9 dokumentace byl metodicky sjednocen\u00fd stavebn\u011b historick\u00fd pr\u016fzkum (SHP). Na\u0161e metodiky byly na sv\u011btov\u00e9 \u00farovni. Sou\u010dasn\u00fd z\u00e1kon nesmysln\u011b upou\u0161t\u00ed od povinn\u00e9ho SHP \u2013 bez n\u011bj nen\u00ed kvalitn\u00ed rekonstrukce objektu mo\u017en\u00e1.<\/p>\n<p>P\u0159\u00edstup k ochran\u011b \u00fazem\u00ed se od ochrany jednotliv\u00e9ho objektu z\u00e1sadn\u011b li\u0161\u00ed sv\u00fdm c\u00edlem: zat\u00edmco u jednotliv\u00fdch pam\u00e1tek usilujeme o zachov\u00e1n\u00ed jejich p\u016fvodn\u00ed fyzick\u00e9 podstaty pokud mo\u017eno v\u00a0nem\u011bnn\u00e9m stavu, m\u011bst\u016fm a z\u00f3n\u00e1m mus\u00edme naopak umo\u017enit dal\u0161\u00ed rozvoj \u2013 tedy zm\u011bnu. Podm\u00ednkou by m\u011bl b\u00fdt po\u017eadavek na zachov\u00e1n\u00ed jejich identity jako celku \u2013 zachovat jejich urbanistick\u00e9 a architektonick\u00e9 hodnoty a z\u00e1rove\u0148 umo\u017enit zm\u011bny, kter\u00e9 k\u00a0sou\u010dasn\u00e9mu \u017eivotu pat\u0159\u00ed. Aby toho bylo dosa\u017eeno, nezb\u00fdv\u00e1 ne\u017e z\u00e1sahy do m\u011bstsk\u00e9 z\u00e1stavby regulovat na z\u00e1klad\u011b sjednocen\u00e9ho metodick\u00e9ho p\u0159\u00edstupu.<\/p>\n<p>Podobn\u011b jako u jednotliv\u00fdch objekt\u016f je nezbytn\u00fd SHP, stejn\u011b nezbytn\u00e1 je i <b>anal\u00fdza sou\u010dasn\u00e9ho stavu pam\u00e1tkov\u011b chr\u00e1n\u011bn\u00e9ho \u00fazem\u00ed jako celku, <\/b>ne jen bezprost\u0159edn\u00edho okol\u00ed \u0159e\u0161en\u00e9 zm\u011bny z\u00e1stavby. M\u011bsto je toti\u017e v\u00edc ne\u017e prost\u00fd sou\u010det jednotliv\u00fdch dom\u016f \u2013 m\u011bsto z\u00a0t\u011bch dom\u016f d\u011blaj\u00ed vztahy, kter\u00e9 jsou mezi nimi, tam je jeho identita. Obdobn\u011b jako je v\u00a0hudb\u011b je melodie v\u00edc, ne\u017e jednotliv\u00e9 t\u00f3ny, ze kter\u00fdch se skl\u00e1d\u00e1. Proto mus\u00edme v\u017edy vyhodnotit celek a od celku hierarchicky postupovat k\u00a0jednotlivostem, ne naopak. V\u00a0r\u00e1mci anal\u00fdzy cel\u00e9ho \u00fazem\u00ed je nutn\u00e9 stanovit kompozi\u010dn\u00ed hodnotu cel\u00e9 z\u00e1stavbu, nejen registrovan\u00fdch pam\u00e1tek. Krit\u00e9riem pro takov\u00e9 hodnocen\u00ed nem\u016f\u017ee b\u00fdt nic jin\u00e9ho, ne\u017e urbanistick\u00e1 kvalita t\u011bchto objekt\u016f zahrnuj\u00edc\u00ed hodnocen\u00ed od postaven\u00ed v\u00a0celkov\u00e9m reli\u00e9fu m\u011bsta (celom\u011bstsk\u00e9 dominanty), p\u0159es um\u00edst\u011bn\u00ed ve struktur\u00e1ln\u00edm celku (m\u00edstn\u00ed dominanty), po vizu\u00e1ln\u00ed celek (n\u00e1m\u011bst\u00ed, ulice), do kter\u00e9ho hodnocen\u00fd objekt bezprost\u0159edn\u011b pat\u0159\u00ed. Teprve takov\u00e9 hodnocen\u00ed n\u00e1m d\u00e1 prostor pro zm\u011bny, kter\u00e9 nepo\u0161kod\u00ed toto\u017enost m\u011bsta (obecn\u011b chr\u00e1n\u011bn\u00e9ho \u00fazem\u00ed).<\/p>\n<p>Urbanistick\u00e1 anal\u00fdza je vysoce kvalifikovan\u00e1 pr\u00e1ce, kter\u00e1 by musela b\u00fdt prov\u00e1d\u011bna podle sjednocen\u00e9 metodiky postupu. Bez tohoto podkladu se n\u00e1m na\u0161e n\u00e1dhern\u00e1 m\u011bsta po z\u00e1saz\u00edch developer\u016f, kte\u0159\u00ed se sna\u017e\u00ed p\u0159edev\u0161\u00edm o maxim\u00e1ln\u00ed zisk, doslova rozpadnou na skrum\u00e1\u017e nesourod\u00fdch objekt\u016f a m\u011bsto svou atraktivitu ztrat\u00ed.<\/p>\n<p>Zajistit z\u00e1konem podm\u00ednky pro tuto pr\u00e1ci a n\u00e1sledn\u00e9 regulativy v\u00a0na\u0161\u00ed dob\u011b je mimo\u0159\u00e1dn\u011b obt\u00ed\u017en\u00e9. Je tu kolize s\u00a0nejasn\u00fdmi vlastnick\u00fdmi pr\u00e1vy k pam\u00e1tce\u00a0vlastnick\u00fdmi i s\u00a0p\u0159edstavou o pot\u0159eb\u011b neomezen\u00e9 kreativity individualisticky orientovan\u00fdch architekt\u016f a developer\u016f, jejich\u017e p\u0159edstavy napl\u0148uje p\u0159edev\u0161\u00edm agresivn\u00ed reklamn\u00ed design. Ten ni\u010d\u00ed svou agresivitou integritu (prioritu) m\u011bstsk\u00fdch prostor\u016f, z\u00e1kladn\u00ed hodnotu historick\u00fdch m\u011bst, kter\u00e1 p\u0159in\u00e1\u0161\u00ed jejich mimo\u0159\u00e1dnou atraktivitu, umo\u017e\u0148uje harmoni\u00ed stylov\u00fdch obdob\u00ed, \u010ditelnost\u00ed n\u00e1m\u011bst\u00ed a ulic. Nejde tu jen o hodnoty zjednodu\u0161en\u011b ch\u00e1pan\u00e9 jako estetick\u00e9, ale o kvalitu m\u011bstsk\u00e9ho prost\u0159ed\u00ed s\u00a0dosud nepochopen\u00fdm v\u00fdznamem pro sou\u017eit\u00ed v\u00a0r\u00e1mci spole\u010dnosti.<\/p>\n<p>V na\u0161\u00ed zemi je je\u0161t\u011b jedna specifick\u00e1 p\u0159ek\u00e1\u017eka \u2013 zpolitizov\u00e1n\u00ed postaven\u00ed postmodern\u00ed architektury \u2013 je myln\u011b ch\u00e1p\u00e1na jako protest proti minul\u00e9mu re\u017eimu, jako umo\u017en\u011bn\u00ed bezmezn\u00e9 kreativity a plurality n\u00e1zor\u016f. Je to paradoxn\u011b poz\u016fstatek zp\u016fsobu my\u0161len\u00ed obdob\u00ed socialismu, kter\u00e9 bylo p\u0159ehnan\u00fdm zpolitizov\u00e1n\u00edm cel\u00e9 spole\u010dnosti poznamen\u00e1no. Podobn\u00fd jev je spole\u010dn\u00fd v\u0161em postkomunistick\u00fdm zem\u00edm, totalitn\u00edm re\u017eim\u016fm a rozvojov\u00fdm zem\u00edm, kde nesmysln\u011b drah\u00e9 postmodern\u00ed projekty maj\u00ed zajistit vstup mezi elitu. Charakteristick\u00e9 je, \u017ee tyto projekty b\u00fdvaj\u00ed na k\u0159\u00eddov\u00e9m pap\u00ed\u0159e m\u00f3dn\u00edch \u010dasopis\u016f prezentov\u00e1ny bez kontextu s\u00a0okol\u00edm.<\/p>\n<p>\u010casto b\u00fdv\u00e1 sly\u0161et n\u00e1mitka, \u017ee v\u00fdrazn\u00e9, mnohdy \u0161okuj\u00edc\u00ed stavby v historick\u00fdch m\u011bstech se n\u011bkter\u00fdm lidem l\u00edb\u00ed, \u017ee si na n\u011b m\u00e1me zvykat. Tady je nutn\u00e9 se zamyslet nad obsahem slova \u201el\u00edb\u00ed\u201c. N\u011bkte\u0159\u00ed lid\u00e9 tak vyjad\u0159uj\u00ed fascinaci n\u011b\u010d\u00edm mimo\u0159\u00e1dn\u00fdm, v\u00fdrazn\u00fdm, \u0161okuj\u00edc\u00edm, ohromuj\u00edc\u00edm technick\u00fdmi vymo\u017eenostmi, reprezentac\u00ed majetku. Nejde tu o hlubok\u00fd z\u00e1\u017eitek skute\u010dn\u00e9ho estetick\u00e9ho uspokojen\u00ed. D\u00e1le si mus\u00edme uv\u011bdomit, \u017ee nen\u00ed mo\u017en\u00e9 nutit \u010dlov\u011bka, aby si zvykal na jin\u00e9 podm\u00ednky\u00a0 vn\u00edm\u00e1n\u00ed prost\u0159ed\u00ed, ne\u017e mu bylo geneticky d\u00e1no. Jde tu o re\u00e1ln\u00e9 ohro\u017een\u00ed p\u0159irozen\u00fdch schopnost\u00ed orientace (smysl pro rovnov\u00e1hu, symetrii, definovan\u00fd prostorov\u00fd celek apod.). \u00a0M\u011bsto je \u017eivotn\u00edm prost\u0159ed\u00edm cel\u00e9 spole\u010dnosti, m\u011blo by j\u00ed poskytovat p\u0159edev\u0161\u00edm samoz\u0159ejmou existenci\u00e1ln\u00ed podporu v\u00a0cel\u00e9 \u0161k\u00e1le situac\u00ed v\u00a0b\u011b\u017en\u00e9m \u017eivot\u011b, ne \u0161okovat, vzbuzovat nep\u0159im\u011b\u0159en\u00e9 emoce, zvedat adrenalin.<\/p>\n<p>.<\/p>\n<p>Aby mohl b\u00fdt pam\u00e1tkov\u00fd z\u00e1kon v\u00a0tomto smyslu \u00fa\u010dinn\u00fd, po\u017eadujeme, aby v\u00a0n\u011bm bylo zakotveno spln\u011bn\u00ed n\u00e1sleduj\u00edc\u00edch po\u017eadavk\u016f:<\/p>\n<p>&#8211; Zpracov\u00e1n\u00ed SHP podle jednotn\u00e9 metodiky pro registrovan\u00e9 pam\u00e1tkov\u00e9 objekty.<\/p>\n<p>&#8211; Zpracov\u00e1n\u00ed prostorov\u00e9 anal\u00fdzy m\u011bst jako celku s\u00a0fin\u00e1ln\u00edm v\u00fdstupem vyhodnocen\u00ed cel\u00e9 z\u00e1stavby do podrobnosti jednotliv\u00fdch objekt\u016f.<\/p>\n<p>&#8211; Zpracov\u00e1n\u00ed regula\u010dn\u00edch pl\u00e1n\u016f (v\u010detn\u011b dopravy, s\u00edt\u00ed atd.) podle jednotn\u00e9 metodiky s\u00a0podrobnost\u00ed jednotliv\u00fdch objekt\u016f na z\u00e1klad\u011b anal\u00fdzy prostorov\u00e9 kompozice i registru pam\u00e1tkov\u00fdch objekt\u016f.
