S\u00e1m investor na <a href=\"http:\/\/obcanskymonitoring.cz\/?p=4080\">ve\u0159ejn\u00e9 diskuzi k Mar\u0161melounu, kterou uspo\u0159\u00e1dal Institut pro rozvoj Prahy<\/a>, vy\u010d\u00edslil sv\u00e9 platby za pozemky na 18 milion\u016f K\u010d. To je humorn\u00e9. Je to cena bytu na Praze 1. Jak jsme zjistili d\u00e1le, m\u00e1 tato platba prob\u011bhnout na z\u00e1klad\u011b smlouvy o smlouv\u011b budouc\u00ed, kter\u00e1 je neplatn\u00e1. N\u00ed\u017ee uv\u00e1d\u00edme listinn\u00e9 d\u016fkazy, omluvte trochu pr\u00e1vnick\u00e9 argumentace, pokus\u00edme se b\u00fdt maxim\u00e1ln\u011b srozumiteln\u00ed a \u010dtiv\u00ed.<\/p>\n<p><!--more--><\/p>\n<p><strong>P\u0159ed prodejem \u010di pron\u00e1jmem je povinnost zve\u0159ejnit z\u00e1m\u011br<\/strong><\/p>\n<p>Chce-li Praha (jak\u00e9koliv m\u011bsto \u010di obec) prodat \u010di pronajmout jak\u00fdkoliv majetek, je povinna nejprve zve\u0159ejnit tzv. z\u00e1m\u011br, \u017ee tak chce \u010dinit.\u00a0Smyslem vyhl\u00e1\u0161en\u00ed z\u00e1m\u011bru je umo\u017enit jak\u00e9mukoliv p\u0159\u00edpadn\u00e9mu z\u00e1jemci na z\u00e1m\u011br reagovat a podat nab\u00eddku. Pokud se tak nestane, je n\u00e1sledn\u00e9 pr\u00e1vn\u00ed jedn\u00e1n\u00ed ze z\u00e1kona neplatn\u00e9.\u00a0Praha n\u00e1sledn\u011b nab\u00eddky vyhodnot\u00ed a m\u011bla by zvolit tu nejv\u00fdhodn\u011bj\u0161\u00ed a s v\u00fdhercem n\u00e1sledn\u011b uzav\u0159e smlouvu. (Pokud nezvol\u00ed ekonomicky nejv\u00fdhodn\u011bj\u0161\u00ed nab\u00eddku, je ze z\u00e1kona povinna tuto volbu vysv\u011btlit.&#8221;<\/p>\n<p>Cituji dot\u010den\u00fd paragraf ze Z\u00e1kona o hlavn\u00edm m\u011bst\u011b Praze:<\/p>\n<p><em>&#8220;\u00a7 36<\/em><\/p>\n<p><em>(1) Z\u00e1m\u011bry hlavn\u00edho m\u011bsta Prahy nebo m\u011bstsk\u00fdch \u010d\u00e1st\u00ed prodat, sm\u011bnit nebo darovat nemovit\u00fd majetek, pronajmout jej nebo poskytnout jako v\u00fdp\u016fj\u010dku hlavn\u00ed m\u011bsto Praha nebo m\u011bstsk\u00e1 \u010d\u00e1st zve\u0159ejn\u00ed po dobu nejm\u00e9n\u011b 15 dn\u016f p\u0159ed schv\u00e1len\u00edm v org\u00e1nech hlavn\u00edho m\u011bsta Prahy nebo v org\u00e1nech m\u011bstsk\u00fdch \u010d\u00e1st\u00ed vyv\u011b\u0161en\u00edm na \u00fa\u0159edn\u00ed desce11a) Magistr\u00e1tu hlavn\u00edho m\u011bsta Prahy nebo na \u00fa\u0159edn\u00ed desce \u00fa\u0159adu m\u011bstsk\u00e9 \u010d\u00e1sti, aby se k nim mohli z\u00e1jemci vyj\u00e1d\u0159it a p\u0159edlo\u017eit sv\u00e9 nab\u00eddky. Z\u00e1m\u011br m\u016f\u017ee hlavn\u00ed m\u011bsto Praha nebo m\u011bstsk\u00e1 \u010d\u00e1st zve\u0159ejnit zp\u016fsobem v m\u00edst\u011b obvykl\u00fdm.\u00a0<strong>Pokud hlavn\u00ed m\u011bsto Praha nebo m\u011bstsk\u00e1 \u010d\u00e1st z\u00e1m\u011br nezve\u0159ejn\u00ed, je pr\u00e1vn\u00ed jedn\u00e1n\u00ed neplatn\u00e9.<\/strong>&#8221;\u00a0<\/em>Z\u00e1kon o hlavn\u00edm m\u011bst\u011b Praze si m\u016f\u017eete p\u0159e\u010d\u00edst\u00a0<a href=\"http:\/\/www.zakonyprolidi.cz\/cs\/2000-131\">zde<\/a>.<\/p>\n<p><a href=\"https:\/\/drive.google.com\/open?id=0B_q_a1M5hm2zNllqRmJsSHBmY00&amp;authuser=0\">Zve\u0159ejn\u011bn\u00ed z\u00e1m\u011bru Magistr\u00e1tu Hlavn\u00edho m\u011bsta Prahy na prodej si m\u016f\u017eete prohl\u00e9dnout zde.<\/a><\/p>\n<p><a href=\"http:\/\/obcanskymonitoring.cz\/wp-content\/uploads\/2015\/04\/Anezsky-klaster-Smlouva-o-budouci-kupni-smlouve.pdf\">N\u00e1sledn\u00e1 smlouva o smlouv\u011b budouc\u00ed kupn\u00ed je zve\u0159ejn\u011bna zde.<\/a><\/p>\n<p>V\u0161imn\u011bte si, jak\u00e9 pr\u00e1vn\u00ed vady obsahuje zve\u0159ejn\u011bn\u00fd z\u00e1m\u011br na prodej:<\/p>\n<ol>\n<li>P\u0159edev\u0161\u00edm neobsahuje cenu zam\u00fd\u0161len\u00e9ho prodeje.<\/li>\n<li>D\u00e1le neobsahuje p\u0159esnou identifikaci parcel (nen\u00ed uvedeno konkr\u00e9tn\u00ed <a href=\"http:\/\/cs.wikipedia.org\/wiki\/Seznam_katastr%C3%A1ln%C3%ADch_%C3%BAzem%C3%AD_Prahy_podle_po%C4%8Dtu_obyvatel\">katastr\u00e1ln\u00ed \u00fazem\u00ed<\/a>, o kter\u00e9 se jedn\u00e1.).\u00a0Podle stanoviska pr\u00e1vn\u00edka, kter\u00e9 m\u00e1m k dispozici, je tento z\u00e1m\u011br neplatn\u00fd &#8211; jakoby nebyl. Na takov\u00fd z\u00e1m\u011br nemohl nikdo reagovat, nebo\u0165 nedok\u00e1zal ur\u010dit, k jak\u00e9mu \u00fazem\u00ed se vztahuje a jak\u00e1 je cena.<\/li>\n<li>D\u00e1le z\u00e1m\u011br neobsahuje ani v\u0161echny parcely, kter\u00e9 byly p\u0159edm\u011btem n\u00e1sledn\u00e9ho prodeje, v kupn\u00ed smlouv\u011b je specifikov\u00e1na parcela 904, kter\u00e1 nen\u00ed uvedena v z\u00e1m\u011bru. &#8211; Dal\u0161\u00ed d\u016fvod neplatnosti.<\/li>\n<\/ol>\n<p>Krom\u011b neplatn\u00e9 smlouvy o smlouv\u011b budouc\u00ed kupn\u00ed, je neplatn\u00e1 i <a href=\"http:\/\/obcanskymonitoring.cz\/wp-content\/uploads\/2015\/04\/Anezsky-klaster-Najemni-smlouva.pdf\">n\u00e1jemn\u00ed smlouva<\/a>. Na to p\u0159i\u0161el u\u017e i s\u00e1m Magistr\u00e1t a dal n\u00e1m tento <a href=\"https:\/\/drive.google.com\/open?id=0B_q_a1M5hm2zdFNpd0lJYTlFbWs&amp;authuser=0\">listinn\u00fd d\u016fkaz o neplatnosti n\u00e1jemn\u00ed smlouvy<\/a>. \u00a0Jak si m\u016f\u017eete p\u0159e\u010d\u00edst v referovan\u00e9m dokumentu, magistr\u00e1t vr\u00e1til developerovi n\u00e1jem a developer neplat\u00ed n\u00e1jem.
