MK 46524\/2017 PI ze dne 18. 07. 2017.<\/p>\n<p>V\u00e1\u017een\u00fd pane doktore,<\/p>\n<p>V\u00a0odpov\u011bdi na na\u0161i \u017e\u00e1dost (d\u00e1le jen odpov\u011b\u010f PI) o\u00a0 proveden\u00ed p\u0159ezkumn\u00e9ho \u0159\u00edzen\u00ed z\u00e1vazn\u00fdch stanovisek Magistr\u00e1tu k\u00a0novostavb\u011b bytov\u00e9ho Domu na rohu ulic U Milosrdn\u00fdch a Koz\u00ed n\u00e1m sd\u011blujete, \u00a0\u017ee Pam\u00e1tkov\u00e1 inspekce nezah\u00e1j\u00ed p\u0159ezkumn\u00e9 \u0159\u00edzen\u00ed z\u00a0d\u016fvodu p\u0159ijet\u00ed novely stavebn\u00edho z\u00e1kona, kter\u00e1 v\u00a0den nabyt\u00ed sv\u00e9 \u00fa\u010dinnosti zbavuje Pam\u00e1tkovou inspekci pravomoci p\u0159ezkoum\u00e1vat z\u00e1vazn\u00e1 stanoviska, kter\u00e1 jsou vyd\u00e1na pro \u00fa\u010dely postup\u016f podle stavebn\u00edho z\u00e1kona. Domn\u00edv\u00e1me se, \u017ee \u00fa\u010dinnost t\u00e9to novely stavebn\u00edho z\u00e1kona nastane a\u017e za 6 m\u011bs\u00edc\u016f a je ot\u00e1zkou jeho retroaktivity, bude-li se v\u016fbec vztahovat na podn\u011bty podan\u00e9 p\u0159ed datem zah\u00e1jen\u00ed jej\u00ed \u00fa\u010dinnosti.<\/p>\n<p>V\u00a0odpov\u011bdi PI se zd\u016fraz\u0148uje, \u017ee Pam\u00e1tkov\u00e1 inspekce se m\u016f\u017ee zab\u00fdvat pouze souladem vydan\u00fdch stanovisek s\u00a0pr\u00e1vn\u00edmi p\u0159edpisy.<\/p>\n<p>Tento soulad jsme pochopiteln\u011b nezpochyb\u0148ovali, m\u011bli jsme na mysli pouze v\u011bcn\u00fd obsah z\u00e1vazn\u00e9ho stanoviska ze dne 9. 12. 2016, kter\u00fdm Magistr\u00e1t n\u00e1vrh stavby bytov\u00e9ho domu schv\u00e1lil. Ocenili jsme, \u017ee byla nicm\u00e9n\u011b v\u00a0odpov\u011bdi PI uvedena \u00a0i v\u011bcn\u00e1 n\u00e1pl\u0148 jednotliv\u00fdch stanovisek v\u010detn\u011b koment\u00e1\u0159\u016f. \u00a0Dovol\u00edme si proto se zam\u011b\u0159it p\u0159edev\u0161\u00edm na tyto \u010d\u00e1sti textu odpov\u011bdi PI. P\u0159edem vylu\u010dujeme ot\u00e1zku barevnosti fas\u00e1d, kterou jsme nikdy nepova\u017eovali za z\u00e1va\u017enou.<\/p>\n<p>Z\u00e1kladn\u00edm probl\u00e9mem, prov\u00e1zej\u00edc\u00edm celou t\u00e9m\u011b\u0159 20 letou histori\u00ed r\u016fzn\u00fdch n\u00e1vrh\u016f z\u00e1stavby drobn\u00fdch parcel mezi ulic\u00ed Koz\u00ed a are\u00e1lem kl\u00e1\u0161tera sv. Ane\u017eky \u010desk\u00e9, je <strong>nedostate\u010dn\u00e9 zd\u016fvod\u0148ov\u00e1n\u00ed sledu zm\u011bn <\/strong>od z\u00e1vazn\u00e9ho vyj\u00e1d\u0159en\u00ed NP\u00da a z\u00e1vazn\u00e9ho stanoviska MHMP \u00a0z\u00a0r. 99 po posledn\u00ed z\u00e1vazn\u00e9 stanovisko MHMP z\u00a06. 12.2016. Jedin\u00e9, co lze na pr\u016fb\u011bhu t\u011bchto zm\u011bn jednozna\u010dn\u011b sledovat, je neuv\u011b\u0159iteln\u00fd \u00a0n\u00e1r\u016fst zastav\u011bn\u00e9 plochy a objemu:<\/p>\n<p><strong>Zastav\u011bn\u00e1 plocha vzrostla z\u00a0p\u016fvodn\u00edch \u00a012 x 21m = 252m2 v\u00a0r. 1999 na 49,765 x 20,105 = 1000, 5253m3 v\u00a0r. 2016 \u2013 to znamen\u00e1 t\u00e9m\u011b\u0159 \u010dty\u0159n\u00e1sobn\u011b zv\u011bt\u0161en\u00ed zastav\u011bn\u00e9 plochy (p\u0159esn\u011b 3,97x). \u00a0Objem vzrostl z\u00a0p\u016fvodn\u00edch 3805m3 v\u00a0r. 1999 na 8862,7m3 (po ode\u010dten\u00ed n\u00e1dvo\u0159\u00ed) v\u00a0r. 2016, to znamen\u00e1 2,3x.\u00a0 To bylo umo\u017en\u011bno i p\u0159id\u00e1n\u00edm 2 parcel, kter\u00e9 byly za zbo\u0159enou\u00a0 ohradn\u00ed zd\u00ed kl\u00e1\u0161tera. Jedna z\u00a0parcel byla za nejasn\u00fdch okolnost\u00ed p\u0159esunuta z\u00a0majetku are\u00e1lu kl\u00e1\u0161tera sv. Ane\u017eky, tedy pam\u00e1tkov\u011b chr\u00e1n\u011bn\u00e1, ur\u010den\u00e1 pouze pro vyu\u017eit\u00ed kl\u00e1\u0161terem.<\/strong><\/p>\n<p>Prvn\u00ed zm\u011bna byla \u201ezd\u016fvodn\u011bna\u201c pouze t\u00edm, \u017ee vyj\u00e1d\u0159en\u00ed z\u00a0r. 1999 se t\u00fdkalo zcela jin\u00e9ho n\u00e1vrhu a bylo mu p\u0159esn\u011b p\u0159izp\u016fsobeno, bez zd\u016fvodn\u011bn\u00ed uplatn\u011bn\u00fdch po\u017eadavk\u016f na objem a materi\u00e1ly. Nov\u00fd n\u00e1vrh je zcela jin\u00fd, tak\u017ee z\u00e1vazn\u00e9 stanovisko z\u00a0r. 1999 nelze d\u00e1le uplat\u0148ovat. Vlastn\u00ed prom\u011bna n\u00e1vrhu z\u00e1stavby zcela chyb\u00ed.<\/p>\n<p>Celou tehdej\u0161\u00ed situaci lze ale rekonstruovat n\u00e1sledovn\u011b:<\/p>\n<p>Z\u00e1vazn\u00e9 vyj\u00e1d\u0159en\u00ed NP\u00da v\u00a0r. 1999 vzniklo s\u00a0nejv\u011bt\u0161\u00ed pravd\u011bpodobnost\u00ed jako v\u00fdsledek pr\u016fb\u011b\u017en\u00e9ho projedn\u00e1v\u00e1n\u00ed n\u00e1vrhu jeho zpracovatelem v\u00a0rozpracovanosti s\u00a0NP\u00da \u2013 to je dosud povinnost a\u00a0 b\u011b\u017en\u00e1 praxe. Schv\u00e1len\u00e9 \u0159e\u0161en\u00ed b\u00fdv\u00e1 t\u00e9m\u011b\u0159 v\u017edy prom\u00edtnuto do vyj\u00e1d\u0159en\u00ed NP\u00da dojednan\u00fdmi konkr\u00e9tn\u00edmi parametry stavby.\u00a0 D\u00e1le zde m\u016f\u017eeme snadno sledovat snahu vyhov\u011bt z\u00e1kladn\u00edm ohled\u016fm k\u00a0existuj\u00edc\u00edm kulturn\u00edm pam\u00e1tk\u00e1m v\u00a0sousedstv\u00ed (kontextu s\u00a0prost\u0159ed\u00edm): korunn\u00ed \u0159\u00edmsa i st\u0159e\u0161n\u00ed h\u0159eben n\u00e1vrhu jsou n\u00ed\u017ee polo\u017een\u00e9 ne\u017e korunn\u00ed \u0159\u00edmsa a h\u0159eben st\u0159echy sousedn\u00edho barokn\u00edho \u0161pit\u00e1lu na rohu ulice Koz\u00ed. Z\u0159eteln\u011b je sledov\u00e1na snaha o sn\u00ed\u017een\u00ed z\u00e1stavby sm\u011brem od \u0161pit\u00e1lu k\u00a0drobn\u00e9 barokn\u00ed uli\u010dn\u00ed z\u00e1stavb\u011b ul. U Milosrdn\u00fdch sm\u011brem ke vstupu do kl\u00e1\u0161tera sv. Ane\u017eky \u2013 dnes NG. Tak\u017ee neod\u016fvodn\u011bn\u00e9 stanovisko z\u00a0r 1999 z\u0159ejm\u011b nebylo, pouze d\u016fvody nebyly ve stanovisku zaznamen\u00e1ny a chyb\u011bla ochota jeho smysl pochopit.<\/p>\n<p>V\u00a0odpov\u011bdi PI dozn\u00e1v\u00e1, \u017ee MHMP zde pochybil, \u017ee zd\u016fvodn\u011bn\u00ed zm\u011bny bylo nedostate\u010dn\u00e9. V\u00a0podstat\u011b nebylo \u017e\u00e1dn\u00e9. \u00a0To, \u017ee \u201e magistr\u00e1t m\u00e1 za to, \u017ee\u201c nebo \u201ePodle n\u00e1zoru Sboru expert\u016f\u201c nelze za zd\u016fvodn\u011bn\u00fd argument pova\u017eovat. Tak\u017ee zat\u00edm co ve stanovisku z\u00a0r. 1999 lze smysl pam\u00e1tkov\u00e9 ochrany vydedukovat, v\u00a0n\u00e1sledn\u00e9m stanovisku, kter\u00e9 zm\u011bnilo parametry stavby, ji\u017e jak\u00e9koli zd\u016fvodn\u011bn\u00ed, c\u00edl ochrany hodnot, zcela chyb\u00ed. I kdy\u017e dal\u0161\u00ed n\u00e1vrhy byly pova\u017eov\u00e1ny\u00a0 za samostatn\u00e1 autorsk\u00e1 d\u00edla, bylo povinnost\u00ed pam\u00e1tkov\u00e9 p\u00e9\u010de je posoudit z\u00a0hlediska pam\u00e1tkov\u00e9 ochrany. \u00a0Chyb\u00ed zde toti\u017e odborn\u00e1 anal\u00fdza existuj\u00edc\u00edch urbanistick\u00fdch, architektonick\u00fdch, historick\u00fdch, um\u011bleck\u00fdch hodnot a symbol\u016f, ke kter\u00fdm by se m\u011bly zd\u016fvod\u0148uj\u00edc\u00ed argumenty odvol\u00e1vat. Pouze kvalifikovan\u00e1 anal\u00fdza st\u00e1vaj\u00edc\u00edch hodnot dot\u010den\u00e9ho \u00fazem\u00ed m\u016f\u017ee b\u00fdt podkladem\u00a0\u00a0 pro\u00a0 schv\u00e1len\u00ed nebo zam\u00edtnut\u00ed n\u00e1vrhu stavby, kter\u00e1 je do n\u011bho nov\u011b situov\u00e1na. Tento nedostatek si uv\u011bdomuje i MMR ve sv\u00e9m dokumentu Politika architektury a kultury v\u00fdstavby z\u00a0r. 2014, kde po\u017eaduje do konce r. 2017 zpracov\u00e1n\u00ed anal\u00fdzy urbanistick\u00fdch a architektonick\u00fdch hodnot ve spolupr\u00e1ci s\u00a0MK. V\u00a0p\u0159\u00edpad\u011b Bytov\u00e9ho domu U Milosrdn\u00fdch je z\u00e1va\u017en\u00e9, \u017ee\u00a0 dal\u0161\u00ed\u00a0 z\u00e1vazn\u00e1 stanoviska na toto pochyben\u00ed navazuj\u00ed, tak\u017ee je tu ot\u00e1zka pr\u00e1voplatnosti cel\u00e9ho mnoho let trvaj\u00edc\u00edho schvalovac\u00edho procesu. Ve h\u0159e je ztr\u00e1ta nenahraditeln\u00fdch kulturn\u00edch hodnot, to je z\u00e1va\u017en\u011bj\u0161\u00ed z\u00e1le\u017eitost ne\u017e souhlas s\u00a0pr\u00e1vn\u00edmi p\u0159edpisy.<\/p>\n<p>Obdobn\u00e1 situace je i v\u00a0p\u0159\u00edpad\u011b posouzen\u00ed stavu ochrany ve\u0159ejn\u00e9ho z\u00e1jmu. Na str. 2 odpov\u011bdi PI je uvedeno, \u017ee \u201epodle n\u00e1zoru Sboru expert\u016f pro pam\u00e1tkovou p\u00e9\u010di n\u00e1vrh p\u0159edstavuje kvalitn\u00edho representanta novodob\u00e9 architektury, kter\u00fd citliv\u011b reaguje na\u00a0 historick\u00e9 prost\u0159ed\u00ed. Op\u011bt jde o n\u00e1zor, kter\u00fd nevych\u00e1z\u00ed z\u00a0anal\u00fdzy hodnot urbanistick\u00fdch, architektonick\u00fdch, stavebn\u011b historick\u00fdch, historick\u00fdch, symbolick\u00fdch ani sociologick\u00fdch t\u00e9to lokality. Nikde nen\u00ed \u0159e\u010deno, \u017ee se zde jedn\u00e1 o mimo\u0159\u00e1dn\u011b cenn\u00fd soubor historick\u00fdch staveb, kde by m\u011blo b\u00fdt zachov\u00e1n\u00ed urbanistick\u00fdch hodnot nezpochybnitelnou podm\u00ednkou. Nebyla hodnocena \u00faloha tohoto souboru v\u00a0panoramatu vltavsk\u00fdch n\u00e1b\u0159e\u017e\u00ed, kde historick\u00e9 soubory jako V\u00fdto\u0148, i M\u00e1nes s\u00a0Vod\u00e1renskou v\u011b\u017e\u00ed, Starom\u011bstsk\u00e9 ml\u00fdny, nedokon\u010den\u00e9 p\u0159edmost\u00ed \u0160tef\u00e1nikova mostu, \u00a0Vod\u00e1rensk\u00e1 v\u011b\u017e u \u0160\u00edtkovsk\u00e9ho jezu jsou jedine\u010dn\u00fdmi \u0161perky v\u00a0z\u00e1stavb\u011b n\u00e1b\u0159e\u017e\u00ed. Asana\u010dn\u00ed z\u00e1stavba v\u00a0ulici U Milosrdn\u00fdch skon\u010dila na ter\u00e9nn\u00ed asana\u010dn\u00ed sp\u00e1\u0159e \u2013 m\u00edsto abychom chr\u00e1nili dochovan\u00e9 hodnoty p\u0159ed asana\u010dn\u00ed sp\u00e1rou na p\u016fvodn\u00edm ter\u00e9nu u \u0159eky, pokra\u010dujeme v\u00a0roz\u0161i\u0159ov\u00e1n\u00ed m\u011b\u0159\u00edtka asana\u010dn\u00ed z\u00e1stavby i do jednoho z\u00a0nejcenn\u011bj\u0161\u00edch historick\u00fdch soubor\u016f, kter\u00e9 se v\u00a0Praze dochovaly. Nebyl vyhodnocen mimo\u0159\u00e1dn\u00fd v\u00fdznam ane\u017esk\u00e9ho kl\u00e1\u0161tera jako symbolu \u010desk\u00e9 st\u00e1tnosti \u2013 t\u011bsn\u00e1 bl\u00edzkost mohutn\u00e9ho objektu s\u00a0utilit\u00e1rn\u00ed bytovou funkc\u00ed degraduje m\u011b\u0159\u00edtko jeho staveb a zneva\u017euje jeho\u00a0 symbolick\u00fd v\u00fdznam pro na\u0161i st\u00e1tnost. Bytov\u00fd objekt p\u0159evy\u0161uje fas\u00e1dy kostel\u016f kl\u00e1\u0161tera o 5,6m, t\u011bsn\u011b p\u0159il\u00e9haj\u00edc\u00ed historickou z\u00e1stavbu ul. U Milosrdn\u00fdch o neuv\u011b\u0159iteln\u00fdch 12,8m.<\/p>\n<p>Dal\u0161\u00edm problematick\u00fdm argumentem magistr\u00e1tu je hodnocen\u00ed staveb v\u00a0pam\u00e1tkov\u00e9 chr\u00e1n\u011bn\u00e9ho \u00fazem\u00ed jako\u201c <strong>jednotliv\u00fdch autorsk\u00fdch d\u011bl <\/strong>s\u00a0konkr\u00e9tn\u00edmi dopady na dot\u010den\u00e9 lokality\u201c (str. 6 odpov\u011bdi PI). V\u0161echna evropsk\u00e1 historick\u00e1 m\u011bsta do konce 19. stolet\u00ed byla po stalet\u00ed budov\u00e1na na z\u00e1klad\u011b priority prostoru. To znamen\u00e1, \u017ee prostor ur\u010doval formu architektury, kter\u00e1 ho vymezovala. Architektura jednotliv\u00fdch objekt\u016f p\u0159i zachov\u00e1n\u00ed individu\u00e1ln\u00ed osobitosti spolupracovala na vytv\u00e1\u0159en\u00ed integrity prostoru. Priorita prostoru pat\u0159\u00ed k\u00a0nejv\u011bt\u0161\u00ed hodnot\u011b \u00a0historick\u00fdch m\u011bst. Jejich prostory vznikaly na z\u00e1klad\u011b tradice i geni\u00e1ln\u00ed intuice stavitel\u016f, zachov\u00e1vaj\u00ed lidsk\u00e9 m\u011b\u0159\u00edtko a odpov\u00eddaj\u00ed geneticky ukotven\u00fdm pot\u0159eb\u00e1m a mo\u017enostem \u010dlov\u011bka pro vizu\u00e1ln\u00ed vn\u00edm\u00e1n\u00ed prost\u0159ed\u00ed. Tyto hodnoty historick\u00fdch m\u011bst jsou nad\u010dasov\u00e9, kv\u016fli nim jsou tato m\u011bsta \u017eivotn\u00edm prost\u0159ed\u00edm mimo\u0159\u00e1dn\u00fdch kvalit a m\u011bly by b\u00fdt p\u0159edm\u011btem ochrany. Bohu\u017eel individualistick\u00e1 modernistick\u00e1 architektura k\u00a0nim neb\u00fdv\u00e1 dostate\u010dn\u011b citliv\u00e1 \u2013 svou agresivn\u00ed snahou o zm\u011bnu a originalitu za ka\u017edou cenu poru\u0161uje prostorovou integritu a t\u00edm po\u0161kozuje hodnoty m\u011bstsk\u00e9ho \u017eivotn\u00edho prost\u0159ed\u00ed. Tady je d\u016fvod mimo\u0159\u00e1dn\u00e9 citlivosti ve\u0159ejnosti na objekty jako byl b\u00edl\u00fd medv\u011bd v\u00a0Dejvic\u00edch, bytov\u00fd d\u016fm (mar\u0161meloun) u Milosrdn\u00fdch, na demolici urbanisticky cenn\u00e9ho t. zv. Koz\u00e1kova domu\u201c na rohu V\u00e1clavsk\u00e9ho n\u00e1m\u011bst\u00ed a Opletalovy. M\u011bsto je p\u0159edev\u0161\u00edm \u017eivotn\u00edm prost\u0159ed\u00edm spole\u010dnosti, nen\u00ed to galerie jednotliv\u00fdch navz\u00e1jem nez\u00e1visl\u00fdch artefakt\u016f. H\u00e1jit bytov\u00fd d\u016fm v\u00a0ulici U milosrdn\u00fdch jako opr\u00e1vn\u011bn\u00e9 autorsk\u00e9 \u0159e\u0161en\u00ed je\u00a0 proto\u00a0 z\u00a0hlediska hodnot historick\u00e9ho m\u011bsta neopodstatn\u011bn\u00e9.<\/p>\n<p>D\u016fm z\u00a0Bofilova ateli\u00e9ru na asana\u010dn\u00ed sp\u00e1\u0159e tak agresivn\u011b nep\u016fsob\u00ed.Vylo\u017een\u011b jako architektonick\u00fd p\u0159\u00ednos ho hodnot\u00ed m\u00e1lokdo. Je sp\u00ed\u0161 spojov\u00e1n s\u00a0pom\u011brn\u011b \u00fasp\u011b\u0161nou rekonstrukc\u00ed Obecn\u00edho dvora. P\u0159edev\u0161\u00edm je je\u0161t\u011b v\u00a0\u00fazem\u00ed asanace. Ploch\u00e9 st\u0159echy rozhodn\u011b pro st\u0159e\u0161n\u00ed krajinu Star\u00e9ho M\u011bsta p\u0159\u00ednosem nejsou. Pokud by p\u0159eva\u017eovaly, zm\u011bnily by podstatu identity panoramatu\u00a0 \u00a0m\u011bsta, m\u011bkk\u00e9 odleh\u010duj\u00edc\u00ed pronik\u00e1n\u00ed jeho \u0161ikm\u00fdch st\u0159ech do prostoru je zcela odli\u0161n\u00e9 od imanentn\u00ed t\u00ed\u017ee ploch\u00e9 st\u0159echy. T\u00edm nen\u00ed \u0159e\u010deno, \u017ee m\u011bkkou transcendenci mezi prostorem a hmotou mus\u00ed realizovat jenom valba nebo sedlov\u00e1 st\u0159echa s\u00a0ta\u0161kami. Sou\u010dasn\u00e1 architektura m\u00e1 k\u00a0disposici mnoho prost\u0159edk\u016f, jak \u0159e\u0161it vztah k\u00a0prostoru jinak ne\u017e vodorovnou plochou. D\u016fle\u017eit\u00e9 je zachov\u00e1n\u00ed m\u011b\u0159\u00edtka a vztahu s\u00a0prostorem \u2013 dobr\u00fdch i vynikaj\u00edc\u00edch v\u00fdsledk\u016f je mo\u017en\u00e9 dos\u00e1hnout r\u016fzn\u00fdmi zp\u016fsoby i materi\u00e1ly. Bohu\u017eel, i kdy\u017e m\u00e1 \u201eSpr\u00e1vn\u00ed org\u00e1n za to, \u017ee v\u00fd\u0161kov\u00e9 i hmotov\u00e9 \u0159e\u0161en\u00ed\u2026.vytv\u00e1\u0159\u00ed p\u0159echod mezi barokn\u00edm \u0161pit\u00e1lem Na Franti\u0161ku a drobnou n\u00edzkopodla\u017en\u00ed z\u00e1stavbou are\u00e1lu Ane\u017esk\u00e9ho kl\u00e1\u0161tera\u201c, nen\u00ed tomu tak.\u201c Jak m\u016f\u017ee takov\u00fd p\u0159echod vytv\u00e1\u0159et objekt p\u0159evy\u0161uj\u00edc\u00ed \u0161pit\u00e1l a tud\u00ed\u017e je\u0161t\u011b v\u00edce p\u0159evy\u0161uj\u00edc\u00ed drobnou z\u00e1stavbu Ane\u017esk\u00e9ho kl\u00e1\u0161tera\u00a0 &#8211; nav\u00edc v\u00a0t\u011bsn\u00e9 bl\u00edzkosti. P\u0159izp\u016fsoben\u00ed v\u00fd\u0161ek m\u011blo z\u0159ejm\u011b na mysli stanovisko z\u00a0r. 1999 \u2013 novostavba byla ni\u017e\u0161\u00ed ne\u017e \u0161pit\u00e1l a byla 31 m vzd\u00e1len\u00e1 od drobn\u00e9 z\u00e1stavby ane\u017esk\u00e9ho kl\u00e1\u0161tera, zat\u00edm co vzd\u00e1lenost mohutn\u00e9ho BD se zkr\u00e1tila na 2m?\u00a0 Dal\u0161\u00ed uveden\u00e1 prohl\u00e1\u0161en\u00ed spr\u00e1vn\u00edho org\u00e1nu na str. 9 \u00a0o citliv\u00e9m za\u010dlen\u011bn\u00ed n\u00e1vrhu je op\u011bt tvrzen\u00edm bez argumentace podlo\u017een\u00e9 kvalifikovanou anal\u00fdzou st\u00e1vaj\u00edc\u00edch hodnot Ha\u0161talsk\u00e9 a Petrsk\u00e9 \u010dtvrti.<\/p>\n<p>Na str. 13 dole je \u010dasto uv\u00e1d\u011bn\u00e9 obhajov\u00e1n\u00ed r\u016fzn\u00fdch novostaveb pouk\u00e1z\u00e1n\u00edm na harmonii r\u016fzn\u00fdch slohov\u00fdch obdob\u00ed, kterou je Praha pov\u011bstn\u00e1.\u00a0 Tato harmonie m\u00e1 ale sv\u00e9 podm\u00ednky, kter\u00e9 zaru\u010duj\u00ed, \u017ee z\u00a0r\u016fznorodosti nevznikne chaos:<\/p>\n<ol>\n<li>v\u0161em slohov\u00fdm obdob\u00edm je spole\u010dn\u00e1 priorita prostoru \u2013 r\u016fzn\u00e9 architektonick\u00e9 slohy tu respektuj\u00ed ur\u010duj\u00edc\u00ed roli prostoru pro \u0159e\u0161en\u00ed stavby.<\/li>\n<li>Slohov\u00e1 architektura respektuje z\u00e1konitost \u010dlen\u011bn\u00ed sv\u00e9 hmoty \u2013 sestupn\u00e9 m\u011b\u0159\u00edtko architektonick\u00fdch \u010dl\u00e1nk\u016f od z\u00e1kladn\u00edch po detail. Detail, zprost\u0159edkuj\u00edc\u00ed bezprost\u0159edn\u00ed kontakt \u010dlov\u011bka se stavbou m\u00e1 mimo\u0159\u00e1dn\u00fd v\u00fdznam. Pal\u00e1c Euro \u017e\u00e1dn\u00e9 protesty ve\u0159ejnosti nevyvolal. V\u010dlenil se snadno do heterogenn\u00edho bulv\u00e1ru doln\u00ed \u010d\u00e1sti V\u00e1clavsk\u00e9ho n\u00e1m\u011bst\u00ed. Jin\u00fd je p\u0159\u00edpad podobn\u011b \u0159e\u0161en\u00e9ho \u00a0Kv\u011btinov\u00e9ho domu, navr\u017een\u00e9ho do dnes ji\u017e kultovn\u00ed \u010d\u00e1sti horn\u00ed. To posiluje dominantnost Musea, kter\u00e9 ve spolupr\u00e1ci se souso\u0161\u00edm sv. V\u00e1clava\u00a0 jen tak z\u00edsk\u00e1v\u00e1 s\u00edlu ovl\u00e1dnout cel\u00fd prot\u00e1hl\u00fd prostor. Proto bylo pro ve\u0159ejnost tak citliv\u00e9 zbo\u0159en\u00ed Koz\u00e1kova domu \u2013 plnil svou prostorovou \u00falohu dokonale a m\u011bl n\u00e1rok na ochranu sv\u00e9ho pl\u00e1\u0161t\u011b. Proto odborn\u00e1 i laick\u00e1 ve\u0159ejnost nev\u00edt\u00e1 \u201ekv\u011btinov\u00fd d\u016fm\u201c, kter\u00fd vydut\u00edm sv\u00e9 fas\u00e1dy, p\u0159ev\u00fd\u0161en\u00edm a v\u011b\u017eovitou dominantou v\u00a0n\u00e1ro\u017e\u00ed a v\u00a0neposledn\u00ed \u0159ad\u011b celosklen\u011bnou fas\u00e1dou poru\u0161uje \u0159\u00e1d horn\u00ed \u010d\u00e1sti n\u00e1m\u011bst\u00ed \u00a0a ohro\u017euje tak integritu cel\u00e9ho prostoru.<\/p>\n<p>Ob\u00e1v\u00e1me se, \u017ee bohu\u017eel odborn\u00e1 \u00farove\u0148 na\u0161ich pam\u00e1tkov\u00fdch org\u00e1n\u016f ustrnula na \u00farovni z\u00e1kona 20\/87Sb. Tento z\u00e1kon p\u0159edpokl\u00e1dal existenci ur\u010dit\u00e9ho konsenzu v\u00a0n\u00e1zorech na pam\u00e1tkovou p\u00e9\u010di, kter\u00fd je\u0161t\u011b do\u017e\u00edval v\u00a0dob\u011b jeho vzniku. Doba se ale po roce 1990 rychle m\u011bnila vp\u00e1dem modernity (postmodernity). Tradi\u010dn\u00ed hodnoty se relativizovaly, architektonick\u00e1 tvorba se st\u00e1vala vypjat\u011b individualistick\u00e1. V\u00a0takov\u00e9 atmosf\u00e9\u0159e se pam\u00e1tkov\u00e9 p\u00e9\u010di neda\u0159\u00ed nejl\u00edp. Proklamovan\u00e1 neomezen\u00e1 kreativita, vyu\u017e\u00edvaj\u00edc\u00ed originalitu a agresivitu forem, omezen\u00e1 pouze t\u00edm, \u017ee vylu\u010duje kontext s\u00a0prost\u0159ed\u00edm,\u00a0 je v\u00a0historick\u00e9m prost\u0159ed\u00ed v\u011bt\u0161inou v\u00a0rozporu s\u00a0jeho hodnotami. Proto je v\u00edce ne\u017e d\u0159\u00edve nezbytn\u00e9 tyto hodnoty identifikovat a chr\u00e1nit. Jinak dosp\u011bjeme od pov\u011bstn\u00e9 harmonie k\u00a0nep\u0159\u00edjemn\u00e9mu chaosu. Posledn\u00ed trendy v\u00a0teorii i praxi jsou u n\u00e1s m\u00e1lo zn\u00e1m\u00e9. Prom\u011bna n\u00e1zor\u016f Rema Koolhaase je sice zn\u00e1m\u00e1 (Preservation Is Overtaking Us), ale z\u0159ejm\u011b z\u016fst\u00e1v\u00e1 nepochopena. Posledn\u00ed psychoanalytick\u00e9 v\u011bdeck\u00e9 v\u00fdsledky t\u00fdkaj\u00edc\u00ed se v\u00fdznamu prostoru pro vizu\u00e1ln\u00ed percepci, v\u00fdznamu m\u011b\u0159\u00edtka staveb atd. se do z\u00e1kona zat\u00edm neprom\u00edtly a neovliv\u0148uj\u00ed ani vyj\u00e1d\u0159en\u00ed a stanoviska na\u0161ich pam\u00e1tkov\u00fdch org\u00e1n\u016f. D\u016fkazem je nez\u00e1jem o funk\u010dn\u00ed prov\u00e1z\u00e1n\u00ed s\u00a0\u00fazemn\u00edm pl\u00e1nov\u00e1n\u00edm &#8211;\u00a0 k\u00a0Politice architektury a stavebn\u00ed kultury (MMR 2014). Sjednoceni terminologie k prov\u00e1z\u00e1n\u00ed\u00a0 se stavebn\u00edm z\u00e1konem opravdu nesta\u010d\u00ed.<\/p>\n<p>Na str. 15 odpov\u011bdi PI je zm\u00edn\u011bn novodob\u00fd \u00a0solit\u00e9r v\u00a0historick\u00e9 z\u00e1stavb\u011b. Tato ot\u00e1zka je citliv\u00e1 i v\u00a0p\u0159\u00edpad\u011b bytov\u00e9ho domu U Milosrdn\u00fdch. Op\u011bt se odvol\u00e1v\u00e1me na existuj\u00edc\u00ed urbanistick\u00e9 hodnoty v\u00a0t\u00e9to lokalit\u011b. Ha\u0161talsko Petrsk\u00e1 \u010dtvrt je dnes heterogenn\u00ed \u00fazem\u00ed spojen\u00e9 p\u0159edev\u0161\u00edm s\u00edt\u00ed sv\u00fdch historick\u00fdch komunikac\u00ed, jejich\u017e trasy a dimenze navazuj\u00ed n\u011bkdy a\u017e k\u00a0d\u00e1vn\u00e9 vesnick\u00e9 z\u00e1stavb\u011b. Tato hodnota nebyla dosud v\u00fdrazn\u011b naru\u0161ena. V\u00a0p\u0159\u00edpad\u011b BD U Milosrdn\u00fdch je situace obzvl\u00e1\u0161t\u011b nep\u0159\u00edzniv\u00e1 \u2013 vznik\u00e1 tu solit\u00e9r na nesmysln\u011b mal\u00e9m prostoru vzhledem ke sv\u00fdm dimenz\u00edm i dispozici s\u00a0\u010destn\u00fdm vstupn\u00edm n\u00e1dvo\u0159\u00edm. Poru\u0161uje zde mimo\u0159\u00e1dn\u011b v\u00fdznamnou uli\u010dn\u00ed stopu \u2013 nen\u00ed nutn\u00e9 dodr\u017eet jej\u00ed polohu, ulice by byla p\u0159\u00edli\u0161 \u00fazk\u00e1, ale jak\u00e9si \u010dlen\u011bn\u00ed fas\u00e1d reflektuj\u00edc\u00ed drobn\u00e9 parcely nenahrad\u00ed jejich jemn\u011b prom\u011bnlivou stopu v\u00a0uli\u010dn\u00ed s\u00edti, kter\u00e1 se prom\u00edtala d\u00e1le do m\u011b\u0159\u00edtka prostoru. V\u00a0historick\u00e9m souboru staveb (Ane\u017esk\u00fd kl\u00e1\u0161ter \u2013 NKP &#8211; a kl\u00e1\u0161tera sv. \u0160imona a Judy Tade\u00e1\u0161e) to pova\u017eujeme za hrubou chybu.<\/p>\n<p>Na stranu 18 odpov\u011bdi PI odpov\u00edd\u00e1me v\u00a0\u00favodn\u00edm odstavci na\u0161eho dopisu.<\/p>\n<p>Na z\u00e1v\u011br bychom r\u00e1di vysv\u011btlili n\u011bkter\u00e1 nedorozum\u011bn\u00ed, kter\u00e1 mezi n\u00e1mi (sdru\u017een\u00edmi a spolky) a pam\u00e1tkovou p\u00e9\u010d\u00ed vznikaj\u00ed. Nejsme nep\u0159\u00e1tel\u00e9, cht\u011bli jsme jednat od roku 2015, kdy jsme zpracovali na\u0161e p\u0159ipom\u00ednky na v\u00fdzvu Dr. \u0160pidly pro vl\u00e1du. P\u0159ipom\u00ednky jsme s\u00a0n\u00edm osobn\u011b dvakr\u00e1t projednali a v\u00a0\u00faprav\u011b, kterou si vy\u017e\u00e1dal, odevzdali. Usilovali jsme i o p\u0159\u00edm\u00e9 jedn\u00e1n\u00ed \u2013 v\u017edy jsme byli odm\u00edtnuti. Uplatnily se a\u017e mezi mnoh\u00fdmi dal\u0161\u00edmi a\u017e ve 3. \u010dten\u00ed n\u00e1vrhu z\u00e1kona.<\/p>\n<p>Uv\u011bdomujeme si n\u011bkter\u00e9 p\u0159\u00ednosy, kter\u00e9 z\u00e1kon nab\u00edzel:\u00a0 Podpora vlastn\u00edk\u016fm pam\u00e1tkov\u011b neregistrovan\u00fdch objekt\u016f v\u00a0chr\u00e1n\u011bn\u00fdch \u00fazem\u00edch je jist\u011b p\u0159\u00ednosem, ale bude-li poskytov\u00e1na plo\u0161n\u011b bez ohledu na urbanistickou hodnotu dot\u010den\u00e9ho objektu, m\u016f\u017ee paradoxn\u011b zp\u016fsobit \u0161kodu. M\u016f\u017ee toti\u017e petrifikovat urbanistick\u00e9 nedostatky, kter\u00e9 by pot\u0159ebovaly n\u00e1pravu. P\u0159\u00edpadn\u011b podpo\u0159it \u00fapravy, kter\u00e9 komposi\u010dn\u011b po\u0161kod\u00ed pam\u00e1tky, prost\u0159ed\u00ed, kter\u00e9 k\u00a0nim pat\u0159\u00ed. Objekt, kter\u00fd v\u00a0d\u016fsledku sv\u00e9 \u0161patn\u00e9 kvality ur\u010den\u00e9 kvalifikovanou prostorovou anal\u00fdzou nem\u00e1 n\u00e1rok na podporu sv\u00e9 \u00fadr\u017eby, m\u016f\u017ee z\u00edskat na cen\u011b pro tot\u00e1ln\u00ed vyhovuj\u00edc\u00ed p\u0159estavbu nebo mo\u017enost demolice s\u00a0n\u00e1slednou novostavbou. Vznik\u00e1 tu i mo\u017enost uplatn\u011bn\u00ed prostorov\u00e9 urbanity m\u011bsta \u2013 tj. diferenciace prostor\u016f podle jejich hierarchie na map\u011b m\u011bsta.<\/p>\n<p>Vad\u00ed n\u00e1m ale, \u017ee st\u00e1vaj\u00edc\u00ed z\u00e1kon ani n\u00e1vrh nov\u00e9ho nedok\u00e1\u017ee zabr\u00e1nit nevhodn\u00fdm z\u00e1sah\u016fm do historick\u00fdch m\u011bst \u2013 nechr\u00e1n\u00ed urbanistick\u00e9 hodnoty.\u00a0 Vad\u00ed n\u00e1m jeho dvojkolejnost. Vad\u00ed n\u00e1m nedostatky v\u00a0jeho v\u011bcn\u00e9m obsahu, kter\u00e9 ho \u010din\u00ed bezmocn\u00fdm proti tlaku developer\u016f.
